Legal Terms for the "KITCHEN DESIGN CONTEST””

 

  1. ORGANIZING COMPANY

     

    Electrolux Hemprodukter AB (hereinafter "AEG") plans to conduct the competition “KITCHEN DESIGN COMPETITION” to select the best kitchen project, according to the details described on the competition website ("Competition").

    This competition applies throughout the national territory in Finland from November 1, 2024 to March 31, 2025, and will be conducted in accordance with the following rules to ensure equality among all participants, which will be published on the website aegcontest.fi. Access will also be valid through the website www. aegcontest.com.

    To carry out the design, implementation, and management of the Competition, AEG collaborates with an external agency.

     

  2. COSTS

     

    Participation in the Competition will be free of charge, so no additional amount will be required. However, all participants bear their own costs related to participate in the Competition.

     

  3. ELIGIBILITY TO PARTICIPATE

     

    The contest is intended for AEG kitchen studio retailers.

    All AEG kitchen studio retailers (may be represented by individuals over 18 years of age) and that are located in Finland may participate in the contest.

    The competition participation criteria are (requirements of article 8): Design, Innovation, Functionality, and Sustainability.

    AEG reserves the right to eliminate a participation after the pertinent checks of said registration.

    The participant accepts these rules at the time of submitting their proposal in the Competition. If acting on behalf of a legal entity, they are authorized to act on behalf of that entity and accept the rules, creating an obligation imposed by law on the legal entity.

     

  4. GENERAL CONDITIONS

     

    AEG reserves the right to cancel, modify or suspend, including a selection of winners and/or participants, totally or partially, for the Competition, or any content, aspect, validation, or criteria at its discretion.

    AEG reserves the right, at its discretion, to disqualify any participant who:

    1. Attempts to modify the registration process or any operation within the Competition;
    2. Violates the rules;
    3. Exhibits inappropriate, unsportsmanlike behavior contrary to the interests of peaceful and calm operation of the Competition.

    AEG will never be responsible to any participant for any damages, including, but not limited to, special, consequential, incidental, direct, or indirect damages, including, but not limited to, loss of profits, data, revenue, and business opportunities, whether or not AEG was aware or should have been aware of the possibility of such damages.

    Under no circumstances will the submission of the proposal, selection, and award of the Competition be understood or interpreted as an offer or employment contract by AEG.

    Participants are not entitled to any compensation or reimbursement for any cost related to this Competition or the Prize. For any questions in this regard, participants can contact: info@aegcontest.fi.

     

  5. COMPETITION PHASES

     

    The competition is divided into four (4) phases: Registration, Voting, Decision and Award Ceremony.

    • Phase 1: Online Registration

      - From November 1, 2024, to March 31, 2025.

    • Phase 2: Online Voting

      - From April 1, 2025, to April 30, 2025.

    • Phase 3: Decision by the Jury Decision

      - in May, 2025

    • Phase 4: Award Ceremony

      in May, 2025, pending confirmation from AEG.

     

  6. PROCEDURE OF THE COMPETITION

     

    1. Registration

       

      Participation begins on November 1, 2024, and the deadline for submitting a proposal ends on March 31, 2025. Kitchen designs created after October 1, 2024, will be accepted, even though the campaign page opens on November 1. Participation is free and will be carried out through the competition website aegcontest.fi.  

      The participant must complete a registration form with the following information.

      • Retailer information: Retailer name, store name, contact person at the retailer including email address (work email), phone number, and how they found out about the Competition.
      • Project Information: Project name and description, explaining why they chose AEG appliances. Example: design, innovation, functionality, and sustainability.

      Participants must upload between three (3) and six (6) images and/or renders of the kitchen design they are participating with, integrating at least three (3) AEG appliances of which at least the oven and one other product must be visible. One of the products can be integrated, but in that case mentioned in the description. Additionally, participants should mark a box indicating whether they have submitted renders or real images of the project in question. It is optional to mention any employees that have been involved. In such case, please keep any personal data limited to names of employees involved.  

      • Once the data and project information have been completed, the participant must meet the following requirements to complete their correct participation in the Competition:

      Requirements:

      • The minimum of three (3) AEG appliances must appear in the images uploaded to the project, with at least one (1) of those images being a detailed photo (zoom, close-up), where the brand logo can be seen, both in renders and real images of each project. At least two (2) of these appliances must be clearly visible, while the third can be integrated but must still be mentioned in the designated text field.
      • It must be a realistic kitchen that can actually be implemented.
      • The contribution may not include products from any brands other than AEG and no other brand than AEG is allowed to be shown in pictures/renders.
      • Social Media. Once the registration is validated and the design is uploaded to the campaign page, the participant must upload at least one (1) image of their project to their social media (Facebook or Instagram). This can be done only after the voting phase has begun. They will send a link or screenshot of the publication in response to the validation email. Depending on the social media, one (1) of the following mentions must be used:

        - Facebook: @aeg

        - Instagram: @aeg

      The following three (3) hashtags must be used in the publication:

       - #AEG

       - #KitchenDesignContest

       - #ChallengeTheExpected

      • The documentation used for participation must not contain confidential information or information about the consumers such as names, addresses, telephone numbers or e-mail addresses.

      Within a maximum of 48 working hours, from Monday to Friday, the participant will receive an email informing about the validation of the images and/or renders uploaded to the Competition website. If everything is correct, the project will be published on the competition website and the participant can share it on their social media after the voting phase has begun.

      In case the requirements are not met, the participant will receive an email. Do not forget to check your inbox as well as the spam folder.

       

    2. Voting and Decision

       

      The participating projects will be evaluated first in the voting by the public, and after that by the professional AEG jury, based on the competition criteria (requirements of article 8).

      The voting process and final decision are divided into the following phases:

      Online Voting: 1.4.2025 – 30.4.2025.

      The five (5) participants with the most votes will advance to the final.

      - Online voting will be limited to a maximum of one (1) vote per project per day, with two (2) being the maximum number of projects that can be voted for each day. This limitation is defined for the same email address. With each vote cast, an email will be sent for proper validation in the competition. Failure to accept (click on the link in said email) will result in the vote not being validated. The purchase of votes during the voting phase is strictly prohibited.

      Decision by the Jury: May, 2025.

      - The professional jury appointed by AEG will choose the winners:

      There will be two (2) winners of the competition from the five (5) finalists chosen by the public in the online vote for this category, whereof one will be placed 1st position and the other will be placed 2nd position.

      The winners will be revealed at a final ceremony at the local AEG offices (in person), where the competition prizes will be awarded (requirements of article 10). This event is planned to take place in May 2025, pending confirmation from AEG.

       

  7. JURY

     

    The jury will be composed of professionals, all chosen for their extensive career and proven experience in the context of design, innovation, sustainability and functionality, and covering the following roles within Electrolux.

    - Sustainability specialist CA North

    - Global AEG Brand Strategy Director

    - Design Director Brand Expression and CMF Care

    - Product Line Taste Director CA North

    The professional AEG Jury will decide, at their sole discretion, the participants who will ultimately be the winners, according to the Evaluation Criteria (requirements of article 8). No member of the Jury (including AEG) will be legally obligated to explain why a participant was not chosen as the winner. The Jury’s decision will be final and irrevocable.

     

  8. EVALUATION CRITERIA

     

    The Jury will evaluate all correctly validated applications according to the four (4) participation and selection criteria for choosing the two (2) winners of the competition.

    - Design

    - Innovation

    - Functionality

    - Sustainability

    The Jury will not consider submissions that:

    1. Are submitted by participants who do not meet the requirements of article 3;
    2. Do not meet the requirements of article 4;
    3. Do not contain appliances with the registered AEG brand;
    4. Are accompanied by insufficient and/or inadequate documentation requirements of article 5.1. (total or partial lack, lack of clarity, and/or unreadability of the minimum essential material required to participate in the Competition).

     

  9. GUARANTEES AND INDEMNIFICATIONS

     

    Each participant declares and guarantees that their proposal:

    1. Is an original work, where the participant is the author of any rights related to intellectual property and any economic exploitation rights without restrictions;
    2. Does not infringe any intellectual property rights of third parties, trademarks, design rights, or copyrights;
    3. Does not violate any third-party trade secrets or other laws (including, without limitation, export control laws);
    4. Is not the subject of a contract with a third party;
    5. Does not contain defamatory content, scandalous considerations, or any other content that may damage the name, honor, or reputation of AEG or any other person in the company;
    6. Does not contain pornographic or sexual content, discriminatory content of any kind (including discrimination based on race, gender, sexual orientation, religion, and/or political beliefs of individuals or groups), does not contain violence or harm to living beings or other offensive, obscene, or inappropriate content;
    7. Does not contain any threats or content intended to intimidate, harass, or abuse someone’s private life; and
    8. Does not constitute a violation of applicable laws and does not include content that encourages illegal conduct.

    The participant guarantees that the information of the CAD files downloaded by the participant to produce and submit the contribution will not be used in any other way than to produce and contribute to the Competition. Notwithstanding the foregoing, the participant may also use the aforementioned CAD files solely for the purpose of designing kitchens for consumers.

    The participant also guarantees that all information, data, and, in general, any other material submitted to the Competition is accurate, correct, truthful, and complete. Therefore, participants assume full and exclusive responsibility for any violation of the above-mentioned guarantees.

    The participant hereby agrees to indemnify and hold harmless AEG and any of its respective affiliates, employees, agents, and suppliers from any claims, actions, liabilities, and settlements arising in connection with a participant’s violation of any provisions of article 5.

     

  10. PRIZES

     

    The professional jury appointed by AEG will choose the best kitchen projects from the finalist designs chosen by the public in the online vote.

    The prizes described below are collectively referred to as “Prizes”:

    1st PRIZE

    - Trip to Rothenburg for two (2) people from the winning store. This includes two (2) round-trip flights, two (2) nights in a shared room and a guided visit to AEG Showroom. Date subject to availability. The prize will be awarded to the store where the winners are employed. The distribution of the prizes is at the sole discretion of the store owner or the store.

    2nd PRIZE

    - Training and dinner for the whole store.

    There is no cash equivalent for the prizes, and the prizes are non-transferable. The prizes may not be exchanged for monetary compensation or any other form of consideration. The allocation and distribution of the prizes are final and at the sole discretion of the organizer. The organizer reserves the right to substitute the prizes with similar arrangement of equal or greater value if necessary.

     

  11. IMAGE RIGHTS AND INTELLECTUAL PROPERTY

     

    The winners of the Competition authorize the organizing company to reproduce, use, and disseminate their name, surname, address, and image in any advertising and/or promotional activity related to the Competition, all in any medium (including but not limited to exploitation through the Internet and internet for mobile telephony) without such activities conferring any right to remuneration or benefit, except for the delivery of the gift won in accordance with these rules.

    The transfer includes all rights of reproduction, transformation, distribution, and public communication of the recording or images captured, without time or territory limitation.

     

    By submitting the contribution, the participant grants Electrolux Group (AB Electrolux and its affiliated companies) the non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to:

    1. Use their name, the company name, as well as the images/photographs contained in the submitted contribution ("Licensed Material"), for promotional and advertising purposes, among others, by publishing any part of the Licensed Material and related materials on any AEG-related internet sites and social networks, or on third-party websites authorized by AEG; or
    2. Alter, edit, modify, change, reform, extract, translate, or summarize the Licensed Material for the purpose set out in article 9.

     

  12. PERSONAL DATA

     

    In accordance with applicable data protection regulations, any personal data provided by participants will be processed and saved by Electrolux group (which includes its subsidiaries such as, but not limited to, Electrolux Hemprodukter AB, Oy Electrolux AB, Electrolux Home Products, Denmark A/S and Electrolux Home Products Norge AS)  whose purpose, in addition to the management of the Competition, may be advertising for all the group's brands. The file manager is Electrolux group, located at S:t Göransgatan 143,

    Stockholm, Sweden. The data will be saved for as long as needed according to the purposes given.

    The participant authorizes Electrolux group to process any personal data voluntarily provided, with the following purposes:
    (i) Processing advertising, promotions, and contests,
    (ii) Managing participation in this contest,
    (iii) Managing the relationship with Electrolux Group,
    (iv) Sending information about Electrolux group’s activities, including electronically,
    (v) The dissemination in web publications, social networks, written media, videos, television, of Electrolux group's activity.

    Electrolux group undertakes to comply with the technical, organizational, and security measures that data protection legislation imposes through Regulation (EU) 2016/679 (General Data Protection Regulation).

    The participant agrees that any personal data provided may be transferred, exclusively for the purposes indicated above, to entities, individuals, or legal entities with whom the different Electrolux group entities conclude collaboration agreements, even when the transfer involves an international data transfer, always respecting the local legislation on personal data protection and without the need to communicate each initial transfer to the aforementioned assignees.

     

    In addition, participants are informed of how Electrolux Group process data and that they may exercise the rights of access, rectification, opposition, and cancellation of the provided personal data, as well as revoke their consent to receive commercial communications, by going to the website www.electroluxgroup.com/privacy.

    The participant will be responsible, in any case, for the accuracy of the data provided, reserving Electrolux group the right to exclude from the registered services any customer who has provided false data, without prejudice to other actions that may proceed in law. The participant will be liable for the damages caused to Electrolux group due to non-compliance with this clause, including the amount of any sanction that may be imposed on Electrolux or any other company or individual to whom Electrolux has validly transferred the data, for such circumstance, all without prejudice to the possible actions reserved, such as disqualifying the participant.

     

  13. EFFECTIVENESS

     

    The obligations contained in the Rules will be effective from the moment of submitting the proposal for the Competition and will remain in effect until the end date of the Competition. The articles, by their nature, will remain in effect until the end of the term of these rules without limiting the articles related to Guarantees and Indemnifications, as Intellectual Property rights, which should prevail over any validity period of these rules.

    AEG reserves the right to cancel, suspend and/or modify this Competition, change or vary any condition or requirement of it and/or these rules, as well as to substitute the prizes or any part of them for a different prize or part of the prize of equal or greater monetary value. In all cited cases, users will be previously informed through the mentioned websites or social media pages.

     

  14. DISPUTE RESOLUTION

     

    The Competition and the rules will be governed and understood under Finnish law. Any dispute that may arise in relation to the Competition and its rules, including disputes related to validation, interpretation, execution, termination, or performance, will be the responsibility of the local Courts and Tribunals in the first instance, excluding any other competent forum.

     

  15. ACCEPTANCE OF RULES

     

    Potential participants are informed that by participating in this promotion, they explicitly and unreservedly accept these rules, as well as submit to the decisions made by the organizing company regarding their interpretation. The rules will be made available for consultation on the promoted brand's campaign site (www.aegcontest.com) and any related platforms, which will redirect to the local campaign sites. In accordance with local regulations, the rules may also be submitted to the relevant local regulatory authorities if required by law.
